The session will feature Club Member David Brodsky, the Principal of Brodsky ADR, and the author of an article entitled Getting Real About Discovery in Arbitrations, published in the March 13, 2020 edition of the New York Law Journal. Mr. Brodsky will be joined by Club Members Richard Ziegler, Principal of AcumenADR LLC, and Marc Goldstein, the Principal of MJG Arbitration & Mediation, who will lead a discussion about reconciling the language of Section 7 of the FAA with today's reality of remote arbitral hearings and whether third party witnesses can be required to appear remotely before a Tribunal.
